Article 1: General provisions

The e-commerce website of Global living ( Otiss ), BV with registered office in Tessenderlo, transportstraat7 Belgium, VAT BE 0893.812.636, offers its customers the opportunity to purchase the products from its online store online.

These General Terms and Conditions ("Terms and Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order through Global Living's online store ( Otiss), the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Global Living ( Otiss).

 

Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately. All items are shipped by Global living ( Otiss), local pickup is not possible. There is a charge for this shipping. These will be mentioned in the check-out process.

The statement of price refers only to the items as it is described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

 

Article 3: Offers

Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Global living ( Otiss). Global living ( Otiss) is, as far as the accuracy and completeness of the information offered is concerned, only bound to a best efforts obligation. Global living ( Otiss) is in no case liable in case of manifest material errors, misprints or printing errors.

If the Client has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we request the Client to contact our customer service department in advance.

The offer is always valid while supplies last and may be modified or withdrawn by Global living( Otiss) at any time . Global living( Otiss) cannot be held liable for the unavailability of a product. If an offer

has a limited validity or is made subject to conditions, this will be explicitly mentioned in the offer.

 

Article 4: Online purchases

The ordering procedure is as follows: the Customer places items in his/her shopping cart, then the Customer clicks through to the "checkout" where a summary of the shopping cart is displayed. Next, the Customer must log in or register with a new customer profile. The confirmation is done via the e-mail address provided by the Customer. Then the Customer chooses the shipping option and payment option. Finally, the Customer accepts the General Terms and Conditions (this document) and the sales contract is concluded.

The Customer has the choice between the following payment methods

- Via Mollie (credit card, bank card or Mollie account) 

- By bank transfer to account number BE14 0019 4535 3083

Global living ( Otiss) is entitled to refuse an order due to a serious fault of the Customer regarding orders involving the Customer.

 

Article 5: Delivery and execution of the agreement

Items ordered via this web store are delivered in Belgium, the Netherlands.

Delivery is made by bPost, DHL or another parcel service and the Customer pays additional costs for this, as mentioned in the order procedure.

Unless otherwise agreed or expressly stipulated, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order.

Any visible damage and/or qualitative deficiency of an item or other shortcoming in delivery must be reported by the Customer to Global living without delay.

The risk for loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice had not been offered by Global living (Otiss).

 

Article 6: Reservation of ownership

Items delivered shall remain the exclusive property of Global Living (Otiss) until paid for in full by the Client.

Client undertakes, if necessary, to draw the attention of third parties to Global Living's retention of title, e.g. to anyone who might come to seize items not yet paid for in full.

 

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase items online from Global Living (Otiss) in their capacity as consumers.

The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the item.

To exercise the right of withdrawal, the Customer must inform Global living (Otiss), Transportstraat 7 - 3980 Tessenderlo, Belgium, info@otiss.nl of its decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post, e-mail). The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.

To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Global living (Otiss), Transportstraat 7 - 3980 Tessenderlo Belgium without delay, but in any event no later than 14 calendar days from the day on which he communicates his decision to withdraw from the contract to Global living (Otiss). The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

If the returned product is somehow reduced in value, Global living reserves the right to hold the Customer liable and claim compensation for any reduction in the value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

If the Customer revokes the contract, Global living (Otiss) will refund to the Customer all payments received from the Customer up to that point, including standard delivery costs, within a maximum of 14 calendar days after Global living has been notified of the Customer's decision to revoke the contract. For sales contracts, Global living (Otiss) may wait to refund until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first.

Any additional costs resulting from the Customer's choice of a mode of delivery other than the cheapest standard delivery offered by Global Living (Otiss) shall not be refunded.

Global Living (Otiss) shall reimburse the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer shall not be charged for such reimbursement.

The Customer may not exercise the right of withdrawal for:

- service contracts after the full performance of the service;

- the delivery or provision of goods or services whose price is subject to fluctuations in the financial market over which Global living (Otiss) has no influence and which may occur within the withdrawal period;

- the delivery of goods manufactured according to specifications of the Customer, or which are clearly intended for a specific person.

- Custom made ( bespoke, made to order e.g. chair with different color/fabric), products manufactured to your requirements.

 

Article 8: Guarantee

Under the Act of September 21, 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to Customer's home, Customer must contact Global living customer service and return the item to Global Living (Otiss) at Customer's expense.

If a defect is detected, the Customer must inform Global living (Otiss) as soon as possible. In any case, any defect must be reported by the Client within a period of 2 months after its discovery. Thereafter, any right to repair or replacement expires.

The (commercial and/or legal) warranty is never applicable to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if any, delivery, shall be deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 10: Sanctions for non-payment.

Without prejudice to the exercise of other rights available to Global living (Otiss), in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without formal notice, to pay interest at 10% per annum on the unpaid amount. In addition, the Client shall be liable, ipso jure and without formal notice, to pay liquidated damages of 10% on the amount in question, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Global living (Otiss) reserves the right to take back items that have not been paid for (in full).

 

Article 11: Privacy

The controller, Global living (Otiss) respects the Belgian law of December 8, 1992 regarding the protection of privacy in the processing of personal data.

The personal data provided by you will only be used for the following purposes: the execution of the concluded agreement, the processing of the order, sending newsletters, advertising and/or marketing purposes.

You have a legal right to access and correct your personal data. Provided proof of identity (copy of identity card), you can obtain the written communication of your personal data free of charge by sending a written, dated and signed request to Global living, transportstraat 7 -3980 Tessenderlo, info@otiss.nl . If necessary, you can also ask to correct the data that would be incorrect, incomplete or irrelevant.

These Conditions are supplemented by other conditions explicitly referred to, and Global living (Otiss) general conditions of sale. In case of contradiction, these Terms and Conditions shall prevail.

 

Article 15: Proof

The Customer accepts that electronic communications and backups may serve as evidence.

 

Article 16: Applicable law - disputes

Belgian law applies, with the exception of the provisions of international private law on applicable law.

The courts of the Consumer's place of residence have jurisdiction in the event of legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
